How to Run Pest Control SMS Without Getting Sued
This is the part most agencies skip, and it is the part that can cost you far more than the campaign ever earns.
- Get real consent. Express written consent means the customer affirmatively agreed to receive texts, with clear disclosure, and you have a record of when and how. A checkbox that is pre-ticked is not consent. A phone number collected for scheduling is not automatically consent to marketing.
- Separate transactional from marketing. An appointment reminder for a service the customer booked is a different legal category than a promotional offer. Structure your consent and your flows accordingly, and do not blur them.
- Honor opt-outs instantly and permanently. STOP means stop, across every campaign, immediately. Your platform should enforce this automatically, and you should verify that it does.
- Respect quiet hours. Do not send marketing messages outside permitted hours in the recipient's time zone. Some states are stricter than federal rules, and a national footprint means the strictest rule governs.
- Register for 10DLC. Carriers require brand and campaign registration for application-to-person messaging. Unregistered traffic gets filtered or blocked, which means you can be sending messages nobody receives and never know it.
- Keep records. Consent logs, opt-out logs, and message history. If you are ever challenged, documentation is the entire defense.
